1. Agreement to Terms

This website (the "Site") is owned and operated by AuraLens Studios ("we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement governing your access to our Site and your engagement with our professional photography services. By using the Site or booking a session with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Our Services

AuraLens Studios provides high-quality, professional photography services, including but not limited to portraits, commercial photography, and event coverage. Our services encompass the entire creative process from initial consultation and planning to the photoshoot session, post-production editing, and final image delivery.

  • Service Agreement: The specific scope of services, deliverables, and fees for your project will be detailed in a separate service agreement or contract, which will be provided to you upon booking.
  • Creative Partners: For certain projects, we may engage trusted third-party professionals such as makeup artists, stylists, or assistants ("Creative Partners"). We will inform you if your project requires such collaboration.

3. Bookings, Payments, and Cancellations

Engaging our services follows a structured process to ensure clarity and commitment from both parties.

  • Booking Confirmation: A photoshoot is considered confirmed only after we have received a signed service agreement and the required non-refundable session retainer.
  • Payment Schedule: A session retainer is required to secure your date. The final balance is due on or before the date of the photoshoot. Final images will not be delivered until the final balance is paid in full.
  • Cancellation & Rescheduling: The session retainer is non-refundable as it reserves our time and prevents us from booking other clients. If you need to reschedule, we require at least 48 hours' notice. We will make one attempt to reschedule your session at a mutually agreed-upon time, subject to availability. Cancellations made with less than 48 hours' notice will forfeit the retainer.

4. Client Responsibilities

To ensure a successful and efficient photoshoot, you, the client, are responsible for the following:

  • Punctuality: Please arrive on time for your scheduled session. Late arrival may result in a shortened session time.
  • Cooperation: Your cooperation and positive attitude are essential for capturing the best possible images. We rely on you and other participants to follow our guidance during the session.
  • Model Release: You will be required to sign a model release form before the photoshoot. This form grants us permission to use the images for our professional portfolio and marketing materials. For any participants under the age of 18, a parent or legal guardian must sign the release.

5. Copyright and Image Licensing

The ownership and usage rights of the photographs are a critical component of our agreement.

  • Copyright Ownership: AuraLens Studios retains the full copyright to all images created during the photoshoot. This is a standard practice in the photography industry and is protected by federal copyright law.
  • Client Usage License: Upon final payment, you will be granted a license to use the delivered images for personal, non-commercial purposes, including printing, sharing on social media, and creating personal albums. The license type (e.g., personal vs. commercial) will be explicitly defined in your service agreement.
  • Prohibited Uses: You are strictly prohibited from editing, altering, selling, or using the images for any commercial purpose (e.g., advertising, business promotion) without obtaining a proper commercial license from AuraLens Studios.

6. Limitation of Liability

While we take every precaution to ensure a successful outcome, unforeseen circumstances can occur. TO THE FULLEST EXTENT PERMITTED BY LAW, AURA LENS STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. In the unlikely event of a total photographic failure (e.g., equipment malfunction or data corruption), our liability will be limited to a full refund of all fees paid or a rescheduled photoshoot at no additional cost.

7. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice by updating the "Last Updated" date at the top of this page. Your continued use of the Site or our services after any such changes constitutes your acceptance of the new Terms.
